Facts:


September of 2011, our client spent RMB290 millions to acquire a real estate development company and its ongoing projects. In the process of project acquisition review, it was found that some underground facilities were found to have non-standard equipment installation and damage, which were not stated in the contract on the acquisition. Our client refused to pay the last payment. so the selling party sued our client for the payment. We represented our client  and listed the relevant mandatory and recommended provisions of the national technical standards and local technical standards in the court. We also showed the relevant evidences of the person who was in charge of the selling party's communication. He made oral commitment to ensure compliance with the mandatory and recommended provisions of the national and local standards. We successfully prove in the court that the selling party broke the contract.


Results:
 

After mediation by the court, both parties have reached an agreement that the selling party shall replace and repair the relevant equipment within the prescribed time limit and all expenses shall be borne by the other party.
